Admissibility of evidence (hearsay / confrontation) Published Appellate Div. decision.  Appellate Div. certified the decision for publication, but on Sept. 17, 2012 the District Court of Appeal transferred the case to themselves for re-hearing. The DCA also ordered that counsel for appellant be provided by Appellate Defenders, Inc.  Once appointed, counsel was to file an opening brief within 40 days.  The DCA's transfer order made it clear that they were aware of the cases at the Cal. Supreme Court.
At about the same time that the DCA took the case, RedFlex' attorneys filed a request for depublication.
Appointed counsel for Appellant never filed an opening brief in the DCA and in Jan. 2013 the DCA granted motion by Appellant's counsel to vacate the transfer.  The case was re-transferred to the Appellate Division.

  Only five of the appellate decisions above have been published.  California Rule of Court  8.1115 says:
"Except as provided in (b), an opinion of a California Court of Appeal

 or superior court appellate division that is not certified for publication or ordered published
 must not be cited or relied on by a court or a party in any other action."

*For a traffic ticket, the first level of appeal is to the Appellate Department (or Division) of the Superior Court of the county in which the case was tried.
The next level of appeal is to the California Court of Appeal, which is divided into six districts. Above that is the California Supreme Court.

**On May 29, 2012, SB 1303 was amended to declare that the documents created by RedFlex or ATS are not hearsay.
